Terms & Conditions

Details of the terms and conditions set out as Peter John Elvin trading as Inspection Testing Services of Pottery Cottage, Fishtoft Drove, Frithville PE2 27ES as we the Supplier or service provider to you the customer. As detailed in the contract details below.

1 Business days include Monday to Saturday but exclude Sunday, Bank Holidays and Christmas day.

Services

2 All due reasonable care will be carried out when carrying out services including the supply of goods which may be exchanged if due to circumstance a similar product is found to enhance the finished product.

3 All work will be completed within the time frame as detailed in our quotation; however, we cannot accept responsibility for external delays beyond our control or site delays due to external influence such as delays from other contractors.

Customer responsibilities

4 We shall require all information relevant to the services provided to be declared during the assessment and prior to us furnishing a written quotation. Delays outside of those declared may result in additional charges.

5 Failure to declare information that enables the timely completion of the service may result in the withdrawal of said services.

 Fees

6 The fees for services provided will be detailed in our quotation and will include labour, materials, and machinery hire.

7 Our fees shall cover the cost of travel expenses and hotel costs as detailed in our quotation; however additional costs may be levied if due to unforeseen circumstances we are delayed in our duties.

8 We shall request additional fees if there are additional materials or services required that are beyond those detailed in the quotation.

9 Our fees are currently excluding VAT.

10 We retain the right to amend the quotation if the date of expiry as detailed on the quotation is exceeded.

11 We or you have the right to decline the quotation offer at any time prior to the acceptance date. The agreement shall be legally binding when there is a verbal agreement or upon furnishing a purchase order.

12 We will willingly discuss any proposal to amend a quotation prior to an agreement being reached.

13 Should circumstances arise that necessitate the occurrence of additional charges we will endeavor to bring this to your attention at the earliest possible moment and will work with you to minimize any additional charge.

Payment

14 We will invoice upon completion of the work as set out in the quotation or as detailed in the quotation describing part payments.

15 The fees due shall be payable within 45 days of the date of the invoice.

16 For invoices not paid within the above time frame we reserve the right to levy an incurred fee of 27.5% per annum more than the invoice charge.

17 All payment shall be made in full without retaining any peat of the invoice unless there was an agreed retainment clause declared before the agreement purchase order.

18 All fees due are in Sterling pounds.

Sub-contracting

19 We reserve the right to use sub-contract labour to assist with the progression of works or services.

20 You are required to inform us if you wish to use a subcontractor for work that may impact on our completion of the agreed works. And further it is your responsibility to ensure that contractors working on the site will not delay the completion of our services.

Termination

21 We reserve the right to terminate our services should we be made aware that you are bankrupt or have been served with a winding up order.

22 We reserve the right to terminate our services if payments due are not met within the above time frame.

23 We reserve the right to withhold materials or certificates if payments due are not met within the above time frame.

Liability and Indemnity

24 Our liability under these terms and conditions and in breach of statutory duty and in tort and misrepresentation or otherwise shall be limited as set out in this section.

25 The total amount of our liability is limited to the total amount of fees by you under the contract.

26 We are not liable whether caused by our employees or otherwise in connection with our provision of services or the performance of any of our other obligations under these terms and conditions or the quotation for any indirect special or consequential loss damage cost or loss of business beyond our reasonable control.

Data Protection

27 We do not hold or store any information or supply any personal information to third parties.

28 We reserve the right to use images of work completed for our web site but will not use photographic material without your permission.

Circumstances beyond control

29 We shall not be liable for delays where those delays are beyond our joint control and may not be limited to fire, flood, earthquake war civil unrest industrial action. We shall both use a 90-day suspension of services if so required

30 Notice of the above circumstances shall be advised in writing.

No Waiver

31 No delay act or omission by a party in exercising any right or remedy will be deemed a waiver of that or any other right or remedy nor stop further exercise of any other right or remedy.

Severance

32 If any of these conditions are deemed to be unlawful then they shall be severed from the remainder of the terms and conditions.

Law

33 The above terms and conditions are served by the laws of the United Kingdom and all disputes shall be governed by English law.
